Mark Levin Interviews Arizona Governor Jan Brewer, Public Support Strong

Governor Jan Brewer issued an executive order last Wednesday prohibiting illegal aliens, granted back door amnesty from the Obama regime, from receiving driver’s licenses or benefits.

Arizona is at war with the Obama regime, or should I say the regime has declared war on Arizona. Arizona is a state overrun with violent illegal aliens. The border there is like a war zone. The Obama regime is doing everything it can to stop Arizona from protecting it’s citizens from these dangerous criminals.

The Phoenix Business Journal reports the citizens of Arizona are solidly behind Governor Brewer on this latest action:

Arizona Gov. Jan Brewer’s office says the vast majority of calls and e-mails it has received over a controversial order banning state driver’s license for young illegal immigrants being given immunity by President Barack Obama are positive.

Public support is running 7 to 1 in favor of the governor’s action, as measured by calls, emails, faxes and letters received by the Governor’s Office of Constituent Services since Wednesday,” said Brewer communications director Matthew Benson.

Benson said there have been 2,037 comments in favor of the Brewer order and 292 against.

The order prohibits young illegal immigrants from getting driver’s licenses or public benefits.

Brewer made the move the same week a new program started from the Obama Administration that allows illegal immigrants brought into the country at young ages by their families to apply for legal status and receive immunity from deportation.

Hispanic groups and Democrats have faulted the Brewer order. The Arizona governor’s office says public opinion, however, is with her.

Public opinion polls also showed support for Arizona’s Senate Bill 1070 immigration law.

Sarah Palin Writes Foreword To Governor Jan Brewer’s New Book, Continues To Support Border Security

Arizona Governor Jan Brewer has a brand new book coming out and Sarah Palin has provided the foreword. The new book centers around the fight to secure our nation’s border from the invasion of illegal aliens.

When Gov. Jan Brewer wanted the perfect person to write the forward on her upcoming book, “Scorpions for Breakfast: My Fight Against Special Interests, Liberal Media and Cynical Politicos to Secure America’s Border,” she turned to an old friend and a lightening-rod of a political figure: former Alaska Gov. Sarah Palin.

Brewer said Palin wasn’t always in the running for the job, but added that as she worked on final edits, she “couldn’t think of anyone better than Sarah.

I reached out to her, and without hesitation, she agreed,” Brewer told The Republic Monday. “I was grateful and thrilled that someone with her prominence could be in the book.

Brewer declined to release specifics about the contents Palin’s forward, or her book, which is slated for release on Nov. 1. But previously released publicity materials suggest that it will focus heavily on Senate Bill 1070, the state’s tough immigration law, her political battles with President Barack Obama’s administration, and the general scope of the immigration problem here in Arizona.

In May 2010, Palin joined Brewer at a north Phoenix news conference to defend SB 1070.

She gets it,” Brewer said of Palin, adding that she has been “supportive” of her fight against illegal immigration and that “she understands the issue.

Brewer told Capitol Media Services she confers regularly with the former Alaska governor. And she sent Palin an advance copy of her book, Scorpions for Breakfast, asking her for a foreword.

Palin obliged.

It’s not surprising,” Brewer said. She noted that Palin came to Arizona last summer (eds: 2010) to have a joint press conference to defend SB 1070. That measure, approved earlier last year by the Legislature, is designed to give police more power to detain and arrest suspected illegal immigrants.

She’s been a very big supporter of what Arizona is doing in regards to the crime on the border and the illegal immigration,” Brewer said.

She’s someone that I’ve always admired,” the governor continued. “I appreciate the fact that she’s stepped forward and did it.

Brewer won’t share what Palin wrote, at least not yet.

She said great things,” was all Brewer would disclose. “It’s very special, I think, to have somebody of a national stature of Sarah, a person whom I admire, another woman in politics, who’s had battles of her own, join with me on the battle on border security and illegal immigration.

The central theme of Brewer’s book is described in its subtitle, is “My Fight Against Special Interests, Liberal Media, and Cynical Politicos to Secure America’s Border.” The governor said she is writing the book to get out what she says is the real story about border security and illegal immigration “and not have all this liberal media spreading THEIR take on what’s taking place in Arizona.

But Brewer said that problem does not start at the state’s borders.

I think that it has been misinterpreted by some of the media here in Arizona,” she said.

Sarah Palin has been standing by Jan Brewer’s supporting Arizona’s SB 1070 and also participated in helping launch Governor Brewer’s Secure the Border website.

Sarah Palin: Barack Obama Lacks “The Cojones To Look Out For All Americans”

Jan Brewer has the cojones that our President does not have, to look out for all Americans, not just Arizonans, but all Americans in this desire of ours to secure our borders and allow legal immigration to help build this country.

In an interview with Chris Wallace for Fox News Sunday Sarah Palin blasts Barack Obama for propensity to blame President George W Bush for his own failures. She rightly points out that Obama was a United States Senator, and part of the Marxist-democrat controlled Congress that created many of the problems we are facing today.

Sarah also takes a big swipe at Obama’s very manhood when talking about the situation in Arizona, and the nation as a whole.

When talking about the economy, Sarah said the democrats were “all wet” on plans to allow the Bush tax cuts to expire. “It’s idiotic to think about increasing taxes at a time like this.” Wallace then repeated the Marxist-democrat spin that keeping the tax cuts would raise the deficit. This is, of course, nonsense. The reason unemployment is so high is businesses, especially small businesses are scared. The situation is so unstable they simply don’t want to hire, or make large capital purchases. Low taxes means they can afford to hire, and more people working, and buying things add to the tax revenue.

It’s a proven fact that lower tax rates see an increase of receipts to the treasury and higher taxes see less. This was true when Kennedy lowered taxes, when Reagan lowered taxes, and of course, when Bush lowered taxes. The only way to control the deficit is to cut the insane runaway spending the Obama regime has embarked on.

Of course, Wallace brought up 2012. Now most are looking forward to a presidential run by Sarah in 2012. We feel she will be one of the finest Presidents we’ve had in quite some time, and her record certainly backs that theory up. With that said, she, like the rest of us, is focused on November 2010 like a laser. If Conservatives don’t take back Congress in 2010, there probably won’t be anything left to be President of in 2012.

Loved her answer about polling, and she takes a nice hit at the lies the media conspired to tell, with their coordination through Journolist.

Interviews like this are exactly why we support Sarah Palin strongly. This is a woman that doesn’t mince words and doesn’t talk a bunch of nonsense. Sarah Palin is a strong leader who DOES have the cojones to look out for all Americans on every issue we face. She is a true leader.

In Arizona Immigration Ruling, Judge Bolton Has No Jurisdiction, And Other Problems For The Obama Regime. UPDATED

From Canada Free Press, a bit of information that should change the entire debate over Arizona’s attempt to protect itself from the invasion from Mexico, and the violent crime it brings. It also brings up many questions that absolutely need answers. (Like why didn’t we figure this out first!)

Look, we all know that Obama, his corrupt Attorney General Eric Holder, and other regime officials never bothered to read Arizona SB 1070 before declaring it “racist” and “unconstitutional.” Of course, the law simply mirrors federal law, only less severe. Other states like California and Florida have similar, but tougher laws. With that said, we know that both Obama and Holder have little more constitutional knowledge past knowing that such a document allegedly exists. I doubt either has read the Constitution fully, or even cares.

With that said, one wonders how Jan Brewer’s defense team missed this one. The Constitution is very clear on this. No wiggle room whatsoever.

Publius Huldah is a retired lawyer who lives in Tennessee. She writes on the U.S. Constitution and posts her papers at publiushuldah.wordpress.com She has this to say about the situation in Arizona:

ONLY the US Supreme Court has Constitutional Authority to Conduct the Trial

Does anyone read the U.S. Constitution these days? American lawyers don’t read it. Federal Judge Susan R. Bolton apparently has never read it. Same goes for our illustrious Attorney General Eric Holder. But this lawyer has read it and she is going to show you something in Our Constitution which is as plain as the nose on your face.

Article III, Sec. 2, clause 2 says:

In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction…

Original” jurisdiction means the power to conduct the “trial” of the case (as opposed to hearing an appeal from the judgment of a lower court). You all know quite well what a “trial” is – you see them all the time on TV shows: Perry Mason, Boston Legal, The Good Wife, etc. Witnesses testify and are cross-examined, etc.

The style of the Arizona case shows quite clearly that the named defendants are:

State of Arizona; and Janice K. Brewer,
Governor of the State of Arizona, in her
Official Capacity, Defendants.

Judge Susan R. Bolton has no more authority to preside over this case than do you

See where it says, “State of Arizona”? And “Janice K. Brewer, Governor of the State of Arizona, in her official Capacity”? THAT (plus Art. III, Sec. 2, clause 2) is what gives the US Supreme Court “original Jurisdiction”, i.e., jurisdiction to conduct the trial of this case. THAT is what strips the federal district court of any jurisdiction whatsoever to hear this case. Judge Susan R. Bolton has no more authority to preside over this case than do you (unless you are a US Supreme Court justice).

In Federalist No. 81 (13th para), Alexander Hamilton commented on this exact provision of Art. III, Sec. 2, clause 2:

…Let us now examine in what manner the judicial authority is to be distributed between the supreme and the inferior courts of the Union. The Supreme Court is to be invested with original jurisdiction, only “in cases affecting ambassadors, other public ministers, and consuls, and those in which A STATE shall be a party.”

Public ministers of every class are the immediate representatives of their sovereigns. All questions in which they are concerned are so directly connected with the public peace, that, as well for the preservation of this, as out of respect to the sovereignties they represent, it is both expedient and proper that such questions should be submitted in the first instance to the highest judicatory of the nation.

Though consuls have not in strictness a diplomatic character, yet as they are the public agents of the nations to which they belong, the same observation is in a great measure applicable to them. In cases in which a State might happen to be a party, it would ill suit its dignity to be turned over to an inferior tribunal….[boldface added, caps in original]

Yet Attorney General Eric Holder filed the case in a court which is specifically stripped of jurisdiction to hear it!

So! Counsel for the State of Arizona should consider:

1. File a Petition for Removal before federal district court Judge Susan R. Bolton demanding that the case be removed to the Supreme Court on the ground that under Art. III, Sec. 2, clause 2, US Constitution, only the Supreme Court has jurisdiction to conduct the trial of this case.

2. If Judge Bolton denies the Petition for Removal, file a Petition for Writ of Mandamus in the Supreme Court asking that court to order Judge Bolton to transfer the case to the Supreme Court.

A Petition for Writ of Mandamus is an old common-law “extraordinary writ”: It asks a court to ORDER a lower court or other public official to something which it is its duty to do. In Kerr v. US District Court for Northern District of California (1976), the Supreme Court said, respecting the propriety of issuing writs of mandamus:

….the fact still remains that “only exceptional circumstances amounting to a judicial ‘usurpation of power’ will justify the invocation of this extraordinary remedy.”…(para 13)

When a federal district court judge presides over a case which the Constitution specifically prohibits her from hearing, and even issues a ruling enjoining the enforcement of a State Law, then that federal district court judge usurps power. She is specifically stripped – by Art. III, Sec. 2, clause 2 – of jurisdiction to preside over the case against the STATE of Arizona and against THE GOVERNOR of the STATE of Arizona.

For procedures for filing the Petition for Writ of Mandamus, see Supreme Court Rule 20.

Article IV, Sec. 4, requires the federal government to protect each of the States against invasion.Not only is the Obama regime refusing to perform this specific Constitutional duty – it seeks to prohibit the Sovereign STATE of Arizona from defending itself! This lawlessness on the part of the Obama regime is unmatched in the history of Our Country.

This is quite the pickle Holder and Dear Leader find themselves in. This is pretty cut and dried. Only the Supreme Court has the jurisdiction to rule on SB 1070, because the Obama regime is suing the sovereign state of Arizona. This would seemingly void everything activist judge, Susan Bolton, has done, including staying parts of the Arizona law.

This isn’t the only problem the Obama regime has though. Chris Battle of U.S. News And World Report offers up this:

Congress Passed an Arizona-Like Immigration Law in 1996

Back in 1996 (when fanny packs were still cool, in some circles) it was time to get tough on immigration, and an interesting little law was passed. Congress deemed it appropriate for state and local law enforcement to enforce immigration law. In the inscrutable manners of Washington (where all legislation seems to be named with insufferably cute acronyms or indecipherable legislative codes that read like security passwords), this law came to be known as 287g.

Want to know what 287g says? Well, just read the law in Arizona. Yes, that law. The one causing protests in the streets of Phoenix, hysteria on cable talk shows and confusion in the courts. The one that empowers state and local law enforcement to enforce immigration law.

The federal law that has been on the books for more than decade … empowers state and local law enforcement to impose immigration law. According to U.S. Immigration and Customs Enforcement, more than 60 jurisdictions in states across the country have taken advantage of this law.

Florida, Virginia, Oklahoma, Ohio, New Hampshire, California, and even Massachusetts are among the states in which local police are enforcing immigration law.

There is one caveat to the law. Homeland Security must approve each state, but with these states, and more, already having the blessing, it would be political suicide for the Obama regime, and the entire Marxist-democrat party for Arizona to be denied.

Anyway you slice it, it looks like Obama, as usual, has handed his fellow travelers another massive headache by putting his radical ideology over common sense.

It will be interesting to see how all of this plays out. 

UPDATED:

An alert reader points out that Congress indeed granted district courts jurisdiction in these cases, so it seems the reporting from Publius Huldah is flawed.

§ 1345 states:

Except as otherwise provided by Act of Congress, the district courts shall have original jurisdiction of all civil actions, suits or proceedings commenced by the United States, or by any agency or officer thereof expressly authorized to sue by Act of Congress.

With that said, there is still the problem with the 1996 law that gives the states the authority to enforce federal immigration law. There are already members of Arizona law enforcement who have went through the proper approval process.

This is still a landmine for the Obama regime.

We do however, apologize for any confusion.

As Obama Apologizes To China, Sarah Palin Says: “Do Your Job, Mr President! Secure These Borders Now!”

If there is any doubt in one’s mind that Sarah Palin is indeed the leader of the free world, I would think last week put an end to that notion forever. Sarah was absolutely everywhere, and leading at every step.

We find ourselves trying to catch up!

To recap, just a tad, Sarah was in Obama’s hometown, raised $100,000 in just an hour for the state Republican Party, then spoke to a sold out crowd at the Rosemont Theater. Read more here.

While in Chicago, Sarah met with Amy Jacobson who told the story of the Highland High School girl’s basketball team who are being oppressed, and used as political pawns, by radical Marxists who are against the Rule of Law. Upon learning of this grave injustice Sarah said: ” Them are fightin’ words when you say a girl can’t play in the basketball tournament … for political reasons … so we are going to see about that.” More here and here.

Sarah spoke at the annual Susan B Anthony breakfast, supporting the right to life, and fired up the crowd to no end, then it was on to South Carolina where she stood with Conservative Nikki Haley and endorsed her bid to be the state’s new Governor. More here. Sarah, while in the neighborhood, also keynoted the annual NRA convention, serving up more red meat.

Sarah also managed to take time to endorse Susana Martinez as the new Governor of New Mexico. Martinez, a true reformer and corruption buster, in the mold of Sarah herself, is exactly the kind of tough leader New Mexico, and our nation, needs. Stacy Drake has more here.

Of all of the events on Sarah’s incredibly hectic schedule, arguably the most important, and far reaching, was the announcement of a new initiative to force the federal government to do it’s job and secure the southern border and stop the invasion by millions of illegal aliens.

This is the second time since Arizona Governor Jan Brewer signed the new law that allows state authorities to enforce federal immigration law that Sarah has appeared by Brewer’s side, showing solidarity.

Sarah then wrote on Facebook:

Mr. President, do your job. Secure our border

Let’s respect the hardworking, accomplished legal immigrants who sacrificed much, contributed selflessly, and helped build America into the greatest melting pot on earth! We need to understand the importance of America’s fair immigration laws.

Erasing U.S. borders will destroy our country as we become less safe – and this national security issue is what Arizona and other border states are addressing with reinforcement of federal immigration laws. They have to do it because the feds aren’t doing it.

I spoke with Arizona Governor Jan Brewer yesterday, and she reminded U.S. citizens that, despite President Obama’s ignoring this grave national security threat, his dismissal of the need for border security is no laughing matter – and it’s being used as a political tool to divide her state along racial lines.

The Arizona immigration law mirrors the fed’s own law. It sure would be helpful if the Obama Administration would read the short 10-page bill before laughing about it and condemning it. And it would be helpful if the media would actually read it before twisting reports on its content.

Meanwhile, the Obama regime’s own Attorney General, Eric Holder, has come out against this common sense legislation, despite the fact he hasn’t even read the 10 page bill. Of course, why would we expect someone from the Obama regime to read a bill? These are the people who sign into law two and three thousand page bills, that absolutely no one has read!

To add insult to injury, an Obama specialty, the regime is now apologizing to China, of all people, for Arizona’s new law. One simply can’t make this sort of thing up. It’s like waking up everyday and living in a bad sit-com. Power Line has the skinny:



Apologizing For Arizona

This is unfreakingbelievable, even for the Obama administration:

The United States and China reported no major breakthroughs Friday after only their second round of talks about human rights since 2002.

The Obama administration wants to push Beijing to treat its citizens better, but it also needs Chinese support on Iranian and North Korean nuclear standoffs, climate change and other difficult issues. …

[Assistant Secretary of State Michael] Posner said in addition to talks on freedom of religion and expression, labor rights and rule of law, officials also discussed Chinese complaints about problems with U.S. human rights, which have included crime, poverty, homelessness and racial discrimination.

He said U.S. officials did not whitewash the American record and in fact raised on its [sic] own a new immigration law in Arizona that requires police to ask about a person’s immigration status if there is suspicion the person is in the country illegally.

What an idiot! China murdered millions of its citizens who opposed the government’s Communist policies and allows most of its people little or no freedom. We, on the other hand, enforce our immigration laws. No, wait–actually we don’t. That’s why Arizona had to take a shot at it. Oh, by the way, Michael Posner, you clueless moron–China actually does enforce its immigration laws.

These dopes are actually proud of themselves for being morally and historically ignorant:

Jon Huntsman, U.S. ambassador to China who was in Washington, told reporters earlier Friday that the rights talks are a useful way to get results on tough issues.

We’re talking about issues that are uncomfortable, quite frankly, but it is a sign of maturity that we can talk about specific cases,” Huntsman said.

Is it unfair to say that the Obama administration consists of a bunch of anti-American ignoramuses? If so, why?

UPDATE: Scott thinks I may be unjust to Huntsman, as it isn’t clear what “specific cases” he is talking about and his comment may have been unrelated to Posner’s apology. Fair enough. But I’ve reviewed the transcript of Huntsman’s remarks and he repeatedly deferred to Posner. Posner, meanwhile, adopted Huntsman’s “mature” comment and explicitly put it in the context of his own apologies for the U.S.:

QUESTION: Was there any areas in which China sort of turned the tables and raised its own complaints or concerns about U.S. practices around the globe or at home? Can you give some examples there –

ASSISTANT SECRETARY POSNER: Sure. You know, I think – again, this goes back to Ambassador Huntsman’s comment. Part of a mature relationship is that you have an open discussion where you not only raise the other guy’s problems, but you raise your own, and you have a discussion about it. We did plenty of that. We had experts from the U.S. side, for example, yesterday, talking about treatment of Muslim Americans in an immigration context. We had a discussion of racial discrimination. We had a back-and-forth about how each of our societies are dealing with those sorts of questions. …

QUESTION: Did the recently passed Arizona immigration law come up? And, if so, did they bring it up or did you bring it up?

ASSISTANT SECRETARY POSNER: We brought it up early and often. It was mentioned in the first session, and as a troubling trend in our society and an indication that we have to deal with issues of discrimination or potential discrimination, and that these are issues very much being debated in our own society.

So Posner’s comments about Arizona were even worse than was reported by the AP. I would suggest to Ambassador Huntsman that if he wants to disassociate himself from the ignorance and the anti-Americanism of the Obama State Department, he should resign.

This is one of those rare times that words simply escape me. America has faced many dangerous enemies in her lifetime, but this is the first time our enemy is sitting in the White House. Barack Obama and the group of ignorant, anti-American, radical Marxists he surrounds himself with are simply to horrible for words….or at least words I can print.

It’s a sad, sad day when the President of the United States is apologizing to China, one of the worst abusers of human rights in history, for upholding the Rule of Law in our own country.

Barack Obama is the enemy of the people. As far as I am concerned, he’s a traitor to the nation. Upon taking the Oath of Office Obama swore to defend America and the Constitution. So far he has done absolutely nothing but apologize for America’s very existence, while seeking to shred the Constitution. We’ve had terrorist attacks on our soil, and instead of acting on them, the Obama regime trots out “lone wolf” theories, and ignores the threat of radical Islam.

And now, as Arizona is forced to do Obama’s job for him, and try to stop the invasion by illegals, Obama sides with the illegal invaders! That’s right, Obama sides with invaders who bring crime to Arizona. Obama sides with invaders who murder, steal, and have turned Phoenix, Arizona into the kidnap capitol of the nation, and second only to Bogota, Colombia in kidnaps worldwide!

Everything Obama does is contrary to the public good. Contrary to the wishes of the American people. It’s disgraceful.

Thank God for Sarah Palin. She is absolutely the only leader who is consistently standing up for America and the American people. One has to ask where is the GOP’s golden boy Mitt Romney, or the other “flavor of the month” establishment country clubbers, who claim they are leaders. Where are hiding?

Support Arizona, and while you are at it, push your state to adopt similar laws. If Barack Obama won’t stand up for the Rule of Law, then by God the rest of us must

Governor Jan Brewer To Obama: No One In Arizona Is Laughing Pal!

Governor Jan Brewer has released a scathing video attacking Obama for his absolutely stupidity on the immigration issue. Arizona is under attack by an invading foreign force, as well as Marxist elements in this country, and… well… Obama himself. The federal government has failed to fulfill it’s constitutional requirement, and protect the nation, and Obama has failed to fulfill the Oath of Office he took to protect America and the Constitution.

He did find the time, however, to make a joke about Arizona at the recent White House Correspondents’ Dinner.

Arizona is not amused.
